By submitting this form and my accompanying artwork entry, I certify that I understand and agree to the terms of the Participation Agreement below. I further certify that my artwork and I are eligible to participate in this exhibit according to the terms in paragraph (1.2) through (5.) of the Participation Agreement. I further certify that all statements submitted by me on this form are accurate and truthful to the best of my knowledge.
An open artist call out titled tentatively "Connecting Earth and Sea: Expressions of Culture and Community in the Caribbean World" (hereafter referred to as the "exhibition") is being conducted by United States Department of State’s (DoS) office of ART in Embassies. This Participation Agreement sets forth the terms under which I am submitting the image of my artwork identified in attached submission form, (hereafter referred to as "my artwork") to participate in the exhibition. Artwork submitted with incomplete submission forms will be disqualified.
1.1. USE OF SUBMITTED ARTWORK IMAGES
Images of selected exhibition artwork submitted to the call out will be curated by the Department of State office of Art in Embassies curatorial division and the U.S. Ambassador to Guyana. Selected artwork will be incorporated into a public exhibition at the official residence of the U.S. Ambassador to Guyana for a period of approximately two and a half years from date of pickup. Actual dates for pickup and return will be determined during process. I will be contacted separately by AIE to coordinate shipment pickup and return once loan forms have been signed.
Any person may enter the call out provided the actual artwork submitted for consideration is in the continental United States at time of submission and will remain there through potential pickup window (approximately 4 months hence from date of callout). If selected artwork is found to not be available for pickup in the continental United States when I am contacted, my art will be disqualified from the exhibition. Particular selection attention will be paid to work depicting the natural environment or otherwise expressing a unique sense of the Caribbean world made by artists from, or whose heritage is from Guyana and other CARICOM member states.
2. COPYRIGHT OF ARTWORK IMAGE
By submitting my artwork to the exhibition, I grant to the United States Government a perpetual, worldwide, non-exclusive, no-charge, royalty free license, without any obligation for accounting to me, to reproduce an image of my artwork with regards to the exhibition, prepare derivative works of, publicly display (including on Internet web pages, etc), and distribute my artwork image in a non-commercial manner, for any purpose, with artwork credit line always included in an appropriate place.
3. REPRESENTATIONS, WARRANTIES
I represent and warrant that (a) my artwork that I am submitting to the exhibition is my own creative work and there are no other individuals or entities that may claim a copyright interest in my artwork or the image of the artwork I am submitting; (b) all information I provide in the submission form is truthful and accurate to the best of my knowledge; (c) my artwork that I am submitting to the exhibition conforms entirely with the restrictions described above in paragraphs and subparagraphs (1) through (2).
4. RELEASE TO USE NAME
By submitting my artwork to the exhibition, I give my permission to the United States Government to use my full name, in any manner and media as it chooses, throughout the world, in perpetuity, for the purposes of publicizing the exhibition (including publicly announcing exhibition participants, runners up, and winners) and publicly exhibiting my artwork and images of my artwork.
5. HOLD HARMLESS, INDEMNIFICATION:
I hereby waive the right to assert any claim of any nature whatsoever against any party relating to the exercise of the rights and permissions granted hereunder. I agree to indemnify, defend and hold harmless the United States Government from any and all claims arising from its use of my artwork image as permitted hereunder.
